Terms of Service

1. Acceptance of Terms

By accessing and using LumiCat ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service. These Terms are between you and FIBREWISE LTD, the company that operates LumiCat (see §19).

2. Description of Service

LumiCat is a visual journal and AI Studio, available as an iPhone app and as a web platform. On iPhone, it lets you capture photos and videos and record the details around them — names, dates, prices, contacts, notes, and other structured information — so you can keep a searchable record of the things you care about. It also includes a built-in AI Studio for transforming your images and generating new media, which you can use on iPhone or in your browser on the web.

The LumiCat mobile app is the primary product. The LumiCat website is a supporting service that lets you use the AI Studio from your browser on the same account. The same account, credits, and Studio creations are available across both.

The service includes:

  • A private, on-device journal for photos, videos, and structured notes
  • Optional iCloud sync across your own Apple devices
  • AI generation of images, video, audio, and other media through a curated catalog of models
  • Reference-image guided generation (image-to-image, image-to-video)
  • Saving, organizing, and exporting your captures and generations

Supported platforms

The LumiCat mobile app is built and tested for iPhone running iOS 26 or later, which is the primary and recommended way to use the service. The web AI Studio is developed and tested primarily on Google Chrome on a desktop computer, which we recommend for the best experience. Other modern browsers, and the web Studio accessed from a mobile browser, should work but are not guaranteed, and the experience may vary. Regardless of the device or browser you use, the service is provided subject to the disclaimers in §9.

3. User Responsibilities

When using our service, you agree to:

  • Provide accurate information when creating an account
  • Use the service only for lawful purposes
  • Not upload inappropriate, offensive, or copyrighted content
  • Respect intellectual property rights
  • Not attempt to reverse engineer or hack the service

4. Credits, Pricing and Fair Usage

LumiCat is not a subscription service. The journal is free to use, and the AI Studio runs on a pay-as-you-go model: you purchase credits and spend them on individual generations at your own pace. Credits are prepaid platform usage, not a promise of a specific number of finished images, videos, or other outputs. Every model in the Studio shows its credit cost up front before you confirm a generation.

  • Credits are a one-time purchase, not a recurring subscription
  • Each generation consumes credits at the rate shown for the selected model at the time of use
  • Credits expire 90 days after your most recent credit purchase or addition. Any new credit purchase extends the expiry of your entire balance by a further 90 days. Your current balance and expiry date are visible from your profile inside the app
  • We may adjust per-model credit pricing or introduce new models with reasonable notice; published prices apply at the time of each purchase

Fair usage and anti-abuse

To protect availability and pricing for all users, we reserve the right to apply reasonable rate limits and anti-abuse measures, and to suspend or terminate accounts that:

  • Attempt to circumvent rate limits, quotas, or safety filters
  • Use automated means to scrape, harvest, or generate at scale outside the intended use of the app
  • Attempt to disrupt, overload, probe, or attack the Service or its infrastructure
  • Otherwise abuse the Service in a way that harms us or other users

5. Credits, Charges, Refunds and Cloud Retention

How generations are charged

Credits are deducted when a generation is submitted for processing. AI models are probabilistic — the same inputs will not always produce the same result, and quality varies between models and providers.

  • A generation that the provider returns as successful is charged and is not refundable, even if the result is low quality, contains artifacts, or comes back as a blank or black image or video. We do not guarantee the aesthetic quality, accuracy, or suitability of any output.
  • If a generation is blocked by content moderation, or fails for an operational reason (for example provider unavailability, a timeout, or a system error), the credits for that generation are automatically refunded to your balance.

Purchase refunds

Credits are digital products. Once credits have been used, they are non-refundable. Refunds may be granted for accidental duplicate purchases, technical failures, or where required by law. Unused credit purchases may be refunded within 14 days at our discretion.

In more detail:

  • Once any credits from a purchase have been used, that purchase is non-refundable
  • Unused credit purchases may be refunded within 14 days, at our discretion, where no credits from that purchase have been consumed
  • Duplicate or accidental purchases and technical failures may be refunded, or compensated with credits, at our discretion
  • Purchases made through the Apple App Store or our web payment provider are also subject to those providers' own refund processing; where an upstream refund is issued, the corresponding credits are removed from your balance
  • Nothing in this section limits the statutory rights you may have under applicable consumer law (including in the UK and EU)

Digital content and your right to cancel

Credits unlock digital content that is supplied to you immediately. By purchasing credits and using them, you ask us to begin supplying that digital content straight away, and you acknowledge that generations begin consuming your credits immediately. Once any credits from a purchase have been used, that purchase is non-refundable, as set out above.

This does not remove your legal rights: if digital content is faulty or is not supplied, your statutory consumer rights under applicable law (including in the UK and EU) are unaffected. Purchases are also governed by the store you bought through — the Apple App Store or our web payment provider — and some refund requests may need to be made through them.

How long your Studio creations are kept

  • Images, videos, or other media you attach to a generation request are held on our servers only briefly to process the request, then removed; they are not kept as a permanent library
  • Your Studio creations are stored in your cloud library so your history is available on the web and across your devices. They remain until you delete them, until your account is deleted, or until the retention window below elapses
  • When your credits expire, your completed creations remain available for a further 30 days. Buying any credit pack within that window extends your credits by another 90 days and keeps your creations. If you do not, your cloud creations are removed from our servers after the 30-day grace period. Copies you have already downloaded or saved to your device are unaffected

6. Content and Intellectual Property

Regarding your content and intellectual property:

  • You retain ownership of media you upload
  • You grant us permission to process your media to deliver the service
  • We do not use your prompts or uploaded media to train AI models
  • You may not redistribute or resell our content

You own the media you generate in the Studio and may use it for personal and commercial purposes. We claim no ownership of your generated media. This ownership is conditional on your use complying with these Terms and applicable law — for example, you must not generate content that is unlawful or indecent, or that uses another person's likeness or identifiable information without the right to do so. Content created in breach of these Terms is not licensed to you.

7. Our Intellectual Property — Studio Presets and Catalog

The LumiCat AI Studio is built around proprietary materials we curate and maintain, including our presets and style templates, prompt and parameter configurations, model selections, the inspirations catalog, and the sample media that illustrate them. These materials, and the software and workflows behind them, are our intellectual property or that of our licensors.

You may not:

  • Copy, scrape, harvest, redistribute, resell, or sublicense our presets, catalog, sample media, or Studio configuration
  • Reverse engineer, decompile, or otherwise attempt to derive or reveal the hidden prompts, parameters, or model settings behind any preset
  • Use automated means to extract the catalog or its underlying configuration

The credit cost shown for a preset reflects the right to generate with it, not a licence to the preset's underlying prompt, parameters, or configuration.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using the service, you consent to the collection and use of information as outlined in our Privacy Policy.

9. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, satisfactory quality, and non-infringement. To the fullest extent permitted by law:

  • We do not warrant that the service will be uninterrupted, timely, secure, or error-free
  • We do not guarantee the accuracy, reliability, or aesthetic quality of generations, which are inherently unpredictable and vary by model and provider
  • You are solely responsible for evaluating outputs for your intended use, including their accuracy, legality, and suitability, before relying on them

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you, and you may have other rights that vary by jurisdiction.

10. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid for the service in the preceding twelve months
  • Users assume full responsibility for their use of generated content

Your data and backups

You are responsible for keeping your own copies of content that matters to you. Your journal in Collections is stored on your device and, where enabled, in your own iCloud account, which we neither hold nor control. To the fullest extent permitted by law, we are not liable for any loss of, or inability to access, your content — including journal records, attached inputs, and Studio creations — whether arising from device loss or failure, iCloud or backup failures, accidental deletion, your deletion of records or your account, sync conflicts between devices, the retention windows described in §5, or any interruption of the Service. We recommend you regularly back up and export anything you wish to keep.

Nothing in these terms excludes or limits our liability where it would be unlawful to do so.

11. AI Service and Third-Party Technologies

Our service utilizes third-party AI providers to deliver generation features. By using our service, you acknowledge and agree that:

  • Your inputs may be processed by third-party AI services
  • You must comply with each provider's prohibited use policies
  • AI-generated outputs are simulations and may contain inaccuracies
  • We may update or change AI providers without prior notice
  • Third-party service availability may affect our functionality

12. Prohibited Uses and Content Restrictions

In accordance with our AI service providers' policies and applicable laws, you may not use the service for any of the following prohibited activities:

General Prohibited Uses

  • Any unlawful purpose or activity
  • Violating any intellectual property rights
  • Transmitting viruses or malicious code
  • Commercial use without authorization
  • Circumventing our safety filters or abuse protections

Content Restrictions — You may not upload or generate

  • Content relating to child sexual abuse or exploitation
  • Content that facilitates violent extremism or terrorism
  • Non-consensual intimate imagery
  • Content that facilitates self-harm
  • Sexually explicit content created for pornography or sexual gratification
  • Content promoting hatred, harassment, bullying, or violence
  • Content that violates others' privacy rights or uses personal data without consent
  • Content intended for fraud, scams, or deceptive practices
  • Content that impersonates individuals to deceive others
  • Spam, phishing, or malware-related content

Age and Safety Restrictions

  • Images of minors (under 18) without verifiable parental consent
  • Content that could facilitate harm to minors
  • Images that track or monitor people without their consent

13. AI-Generated Content Disclaimer

Important disclaimers regarding AI-generated content:

  • All outputs are AI-generated and not professional advice
  • AI results may contain inaccuracies, artifacts, or unexpected variations
  • Generated content should not be considered as human-created artwork
  • We cannot guarantee the accuracy, completeness, or suitability of AI outputs
  • AI processing is subject to the terms and limitations of our third-party providers
  • The quality of any output depends heavily on the quality of the images you attach, whether you are using a preset or your own custom prompt. Low-resolution, blurry, obscured, poorly lit, or heavily compressed inputs make poor results more likely
  • When you ask a model to edit or transform an attached photo — particularly one containing a face — the model may not preserve facial features, expressions, or a person's likeness. Depending on the model, the attached subject may be altered significantly, only loosely resembled, or in some cases not incorporated into the output at all. This is an inherent characteristic of current generative models and is expected behaviour with some of them; it is not a defect in the Service, and such generations are charged and not refundable as set out in §5. We expect this to become less common as models improve
  • When you choose an output aspect ratio, we ask the selected model to match the closest supported ratio. How the model honours that request is outside our control and varies by model — some models may stretch, crop, or otherwise alter your reference images in ways that may be undesirable, particularly when editing a single image into a different aspect ratio. For the most predictable results, use a reference image whose aspect ratio matches, or is close to, your chosen output ratio

14. Content Monitoring and Enforcement

To ensure compliance with these terms and our AI providers' policies, multiple automated safety systems — both ours and each AI provider's — operate throughout the generation process, checking requests and outputs:

  • We may monitor submitted content using automated systems
  • Prohibited content is automatically rejected or removed, and the related credits are refunded
  • Repeated violations may result in account suspension or termination
  • We reserve the right to refuse service to users who violate policies
  • Appeals for content decisions can be submitted through our support channels

15. Account Termination and Deletion

We reserve the right to terminate or suspend accounts that violate these terms, including violations of AI service provider policies. You may also terminate your account at any time by using the account deletion feature in the app, or by reaching out through the support channels listed in §19.

The LumiCat mobile app is the primary product. The LumiCat website is a supporting service that lets you use the AI Studio from your browser on the same account. Account deletion behaves differently depending on which surfaces you have used:

  • Web-only account (you have only ever used the website and have not signed in on the mobile app): the "Delete Account" option on the website fully and permanently deletes your account, including your sign-in identity, Studio creations, credits, and purchase history. This is a complete erasure.

  • Account also used on the mobile app: the mobile app stores data on your device and in your private iCloud backup that the website cannot access. To delete your account fully you must do it from the mobile app — open LumiCat on your phone and use the in-app "Delete Account" option, which removes your sign-in identity, all server-side data, and the data stored on your device and in iCloud. The "Clear Studio data" option that appears on the website in this case only removes your Studio creations from the cloud and is not a substitute for full account deletion.

In all cases you can also contact us via the support channels in §19 to request deletion and we will process it on your behalf.

16. Age Restrictions

Users must be at least 13 years old to use this service. Users under 18 should have parental supervision and consent. We do not knowingly process media of minors without proper consent.

17. Changes to Terms

We reserve the right to modify these terms at any time, including changes required by our AI service providers or applicable law. Users will be notified of significant changes, and continued use of the service constitutes acceptance of modified terms.

18. Governing Law

These terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these terms, except where mandatory local consumer law gives you the right to bring proceedings in your country of residence.
